2. Registration, processing and use of personal data

Person-related data are data on business or personal circumstances of a given or identifiable natural person. This includes, for example, your name, your telephone number, your address as well as all file data you communicate to us upon registration and when creating your customer account.

2.1 Customer account

We create a customer account for every customer who registers with us via the "register now" function, i.e. a password-protected direct access to their file data stored with us. Here you can, among other things, view details of your completed, open and recently sent orders or manage your personal data and newsletter.

2.1.1 Create customer account

The following data must be provided when registering for a customer account (mandatory information):

  • Your e-mail address
  • Your password
  • Your first name
  • Your surname
  • Your gender
  • Consent for credit check and data protection provisions

You do not need to provide your billing and delivery address until you place an order. For your order, we need your correct name, address and payment details. We need your e-mail address so that we can confirm receipt and dispatch of your order and in general so that we can communicate with you. We also use your e-mail address for your identification (as login name) when you log into your customer account.

2.1.2. Use of customer account

You can use your The Essentials customer account to log into the various European The Essentials online shops. We only provide your data to these services when you log in there. Should it not be a The Essentials B.V., service, the data will also only be passed on with your consent, which you can give in the corresponding login process. If you do not log out of your customer account, you will automatically remain logged in. This function allows you to use some of our services (e.g. "Wish list") even without logging in to the customer account again. However, for security reasons, you will be asked to enter your password again if, for example, your personal data needs to be changed or you want to place an order.

2.1.3. My preferences

You can indicate on The Essentials whether and which brands or categories you find particularly interesting and which brands do not interest you. To do this, you have access to the so-called "My Preferences" function; your information can be viewed and modified at any time in your customer account. We use your information to personalise your homepage, among other things, in order to make our service even more relevant and interesting for you.

2.2 Recording, processing and use of your personal data

We collect, process and store your data for the entire processing of your purchase, including any subsequent disclaimers, for our service (e.g. "My preferences"), for technical administration, for our own marketing purposes (more information on this under point 2.3) and to prevent criminal acts and fraud. Your personal data are only passed on to third parties to the extent permitted by law, also for the purpose of contract settlement or settlement, for marketing purposes or if you have given your prior consent. Within the scope of order processing, the service providers used by us (e.g. hauliers, logistics companies, banks), for example, receive the necessary data for order and order processing. The data thus transmitted may only be used by our service providers to fulfil their task.

2.3 Use of your data for advertising purposes

In addition to processing your data for processing your purchase from The Essentials, we also use your data for the following purposes: to permanently improve your shopping experience and to design it customer-friendly and individually for you; to communicate with you about your orders and about certain products or marketing campaigns; and to recommend products or services to you, which may be of interest to you. We use existing information for this purpose, such as, for example, receipt and reading confirmations of e-mails, information about the end device you use, your connection to the internet, operating system and platform, date and time of the visit to the homepage, or products you have viewed and information we have received from you (including automatically transferred or generated information). In addition, we also use your order history. You can object to the use of your personal data for advertising purposes in its entirety or for certain activities at any time, without incurring any costs other than the transmission fees according to the basic rates. A communication in textual form to the contact details listed under point 1 (e.g. e-mail, fax, letter) is sufficient for this purpose.

2.3.1 Newsletter

To send the newsletter, we use the e-mail address provided by you and require your confirmation that you, as owner of the e-mail address, agree to receive it. Should you no longer wish to receive a newsletter from us, you can object to this at any time, without incurring other than the transmission costs according to the basic rates. A communication in textual form to the contact details listed under point 1 (e.g. e-mail, fax, letter) is sufficient for this purpose. It goes without saying that you will also find an unsubscribe link in every newsletter.

2.3.2 Product recommendations by e-mail

As a customer of The Essentials, you will regularly receive product recommendations from us by e-mail. You will receive these product recommendations from us regardless of whether you have subscribed to a newsletter. In this way, we want to send you information about products from our collection that might be of interest to you based on your latest purchases from us. If you no longer wish to receive product recommendations or, as a whole, advertising messages from us, you may object at any time, without incurring charges other than transmission fees according to the basic rates. A communication in textual form to the contact details mentioned under point 1 (e.g. e-mail, fax, letter) is sufficient for this purpose. Naturally, you will also find an unsubscribe link in every e-mail.

2.3.3 Advertising banners

We also use the data collected during your visit to show you so-called advertising banners. These are advertisements which we place on the pages of third parties. This usually involves the use of so-called cookies or pixels. It is our goal to make the advertising offer more useful and interesting for you, which is why in the context of the advertising banners you will especially see products that you have already viewed on our site or products that are similar to those you have viewed (so-called retargeting). In the context of the advertising banners, we only work with pseudonymous data; information in non-encrypted textual form about your person (e.g. your name or your e-mail address) is not stored in the cookies. More information on cookies, pixels and retargeting can be found in section 4 and section 7 of this policy.

2.3.4 Games of chance, market and opinion research

In the case of games of chance, we use your data for the purpose of notifying you about prizes won and advertising our offers. Detailed instructions can be found in the participation conditions of the respective game of chance. We also use your data for market and opinion research purposes. The data collected within the scope of market and opinion research will not be used for advertising purposes. Detailed instructions (in particular regarding the evaluation of your information) can be found in the context of the respective survey or where you enter your information. Your answers in surveys will not be passed on or published to third parties. You can object to the use of data for market and opinion research at any time in its entirety or for certain activities, without incurring any other than the transmission fees according to the basic rates. A communication in textual form to the contact details mentioned under point 1 (e.g. e-mail, fax, letter) is sufficient for this purpose. Naturally, you will also find an unsubscribe link in every survey.

3. Credit check

In order to be able to offer you the best possible choice of payment method, we need to protect you and us against abuse. This is why we send the personal data required for a solvency check, including your address details, to the company Experian NL. To be reached at:

Online contact form: http://www.experian.nl/contact/contact-consumenten.html E-mail: Inzage@experian.nl Telephone number: 0900-experian (0900-39737426) Address: PO Box 16604, 2500 BP The Hague Visiting address: Office building 't Schip Consumer Desk 9th floor Verheeskade 25 2521 BE The Hague.

which performs a corresponding assessment based on mathematical-statistical methods. When calculating the probability value, your address data are also used. We use the information received with regard to the statistical probability of a payment failure ("probability value") for an informed decision regarding the payment options to be granted to you.

If you do not agree with the payment method(s) offered to you on the basis of this automated method, you may inform us in writing by letter or by e-mail to info@swimessentials.nl. We will then review the decision given your point of view.

You may object to the transmission of your data to Experian at any time. A communication in textual form (e.g. e-mail, fax, letter) is sufficient for this purpose. Please note, however, that in this case you can only use prepayment as a payment option.

4. Cookies

4.1 Introduction

As indicated in the cookie banner, The Essentials uses various types of cookies, web beacons and JavaScripts (hereinafter collectively referred to as "cookies") on its websites.

In this cookie policy we explain what these cookies are, what these cookies are used for and how you can adjust your browser settings to accept or reject cookies.Accepting cookies is not a condition for visiting our website. However, please note that using the shopping basket function and ordering products is only possible with the activation of cookies.

4.2 Consent

Some of the cookies used by The Essentials require your prior consent under Dutch law. This cookie policy indicates which cookies are concerned.

By clicking "I agree" in the cookie banner or by continuing to use this website, you consent to the setting of all cookies described below when visiting this website or other websites of The Essentials. You continue to use this website (and therefore consent to the placement of all cookies) by clicking on any part of The Essentials' web pages (other than opening this cookie policy or The Essentials' privacy statement) or browsing to other pages of The Essentials B.V. websites. If you do not consent to the setting of all cookies as described in this cookie policy, you should not use and leave The Essentials B.V. websites.

4.3 What are cookies?

A cookie is a small text file that is placed on your computer when you visit a website. Information is stored in this text file. This information can be read by the website during a later visit. Some of these cookies are necessary because otherwise the site cannot function properly. Other cookies are used to increase the ease of use of the site for the visitor. For instance, to securely remember your user name and language preference. This saves you having to enter this information each time you visit. Some cookies are used to show you targeted advertisements on The Essentials websites.

Web beacons are small graphic images on a web page that are hidden from the user, and which allow visits and usage of a web page to be measured.

A JavaScript is a programme placed on the user's peripherals and executed from the peripherals. By executing this programme, The Essentials can determine where the visitor is and what actions are performed. In this way, The Essentials gains a better understanding of the visitor's behaviour, which allows The Essentials to better design the website and advertise more effectively on the internet.

4.4 What types of cookies does The Essentials use and what for?

The cookies used by The Essentials can be divided into several categories, as explained below.

Functional cookies

This category of cookies is needed to ensure that the website works properly. For example, these cookies ensure that information from one page is carried over to the next. So you don't have to fill in the same information every time. Also, these cookies ensure that certain preference settings you have indicated for using a The Essentials website (such as language settings or text size) are remembered during future use of the websites. The use of these cookies does not require your prior consent.

Analytical cookies

These cookies are needed to keep our websites permanently as responsive as possible to the needs of our users by anonymously determining how users use our websites. Given the minor impact of these cookies on your privacy, no consent is required for their use. These analytical cookies also include cookies set and read by third parties on behalf of The Essentials, such as Webtrekk and Google Analytics.

Social media cookies

In order to easily share the content of our websites with others through buttons, we use social media cookies from the social media parties so that various social media parties can recognise you. For the cookies that the social media parties place when you click on the buttons and the data that can be collected with this, please refer to the statement of these various parties. The use of these cookies requires your consent.

  • Twitter
  • Pinterest

Advertising/profiling cookies

Advertisements are displayed on The Essentials B.V. websites. Some of these advertisements use cookies. These cookies are placed by us and by third parties on our website so that advertisements relevant to you may be displayed. The use of these cookies requires your consent.

For example, we use Doubleclick, a service provided by Google to show you relevant ads. Through the use of this service, we collect information based on previous visits to our or other websites on the internet. In the process, a pseudonym identification number (ID) is assigned to your browser to check which ads were shown in your browser and which ads were called up. The cookies do not contain any personal information. A transfer of this data by Google to third parties only takes place on legal grounds or in the context of order data processing. A transfer of this data by Google to third parties only takes place on the basis of legal regulations or in the context of order data processing. Under no circumstances will Google combine your data with other data recorded by Google.

You can prevent Google from collecting and processing the data generated by the cookie and relating to your use (including your IP address) by downloading and installing the browser plugin available at the following link . Alternatively, you can deactivate Doubleclick cookies on the Digital Advertising Alliance site via the following link .

Affiliate cookies

The category of advertising cookies also includes cookies used for 'affiliate marketing'. These cookies provide information about the effectiveness of a displayed ad; the cookie tracks whether a purchase has been made as a result of a displayed ad. Based on this information, the advertiser of the relevant advertisement can be rewarded.

Given their low impact on users' privacy, the use of these cookies does not require consent.

Tracking cookies

Tracking cookies are used to collect information about your browsing behaviour on our website so that we can analyse our website and continue to improve it. We also use these cookies for future advertising purposes.

The use of these cookies requires your permission.

Random cookies

Due to the way the internet works, The Essentials cannot always control what cookies are set by third parties through our websites. An example of how this may happen is if website content stored at other parties is displayed on our websites. Should this be the case, we would greatly appreciate you letting us know.

Click here for a list of the cookies we use. Although The Essentials tries to keep this list up to date, it may not always be.

4.5 Amendments to cookie policy

The Essentials may make changes to this cookie policy from time to time, without notifying you, because, for example, its website or cookie regulations change. Changes will take effect immediately once they have been published on the website. We recommend that you consult this cookie policy regularly to be aware of any changes and, if desired, adjust settings. By continuing to use this website, you agree to any changes to the cookie policy.

5. Log files

Each time you access The Essentials' sites, usage data is transmitted by the relevant Internet browser and stored in protocol files known as server log files. The stored data records contain the following information: date and time of the call, name of the site called up, IP address, referrer URL (origin URL from which you arrived at the websites), the amount of data sent, product and version information of the browser used. We evaluate these logfile data records to further improve our offer and The Essentials shop and make them more user-friendly, detect and fix errors faster as well as direct server capacity. At the same time, we use the log file data records as a defence against attacks on our The Essentials shop, e.g. in the context of so-called distributed-denial-of-service attacks, which aim to block access to our The Essentials shop due to an overload of requests.

6. Web analytics

In order to continuously improve and optimise our offer, we use so-called tracking technologies. For this purpose, we use the services of Google Analytics and Webtrekk.

6.1 Google Analytics

This website uses Google (Universal) Analytics, a web analysis service of Google Inc. (www.google.nl). Google (Universal) Analytics uses methods, which allow analysis of the use of the website by you, such as for example "cookies", text files that are stored on your computer. The information created about your use of this website is normally sent to a Google server in the USA and stored there. By activating IP anonymisation on this website, the IP address is thereby truncated for transmission within the member states of the European Union or in other treaty states of the European Economic Area Agreement. Only in exceptional cases will the full IP address be transferred to a Google server in the USA and abbreviated there. The anonymised IP address provided by your browser within the scope of Google Analytics will not be merged with other Google data. You can prevent the registration of the data generated by the cookie and relating to your use of the website (including your IP address) with Google and the processing of this data by Google by downloading and installing the browser plug-in available under the following link: http://tools.google.com/dlpage/gaoptout?hl=nl .

As an alternative to the browser plug-in, you can click on this link to prevent the registration by Google Analytics on this website in the future. In doing so, an opt-out cookie will be stored on your end device. If you delete your cookies, you must click the link again.

7. Retargeting and data recording by third parties for advertising banners

In the context of retargeting and advertising banners, we use third-party services, which place cookies on our site. These include the following providers:

8. Secure data transfer

Your personal data is transmitted securely with us by encrypting it. This naturally also applies to your order and to the customer login. We use the TLS (Transport Layer Security) or SSL (Secure Socket Layer) encryption system. Furthermore, we secure our websites and other systems by means of technical and organisational measures against loss, destruction, access, modification or dissemination of your data by unauthorised persons.
